ActuateCare Terms of Use

Thank you for choosing ActuateCare ("ActuateCare", "We", "Us", "Our"). ActuateCare provides access to comprehensive virtual healthcare services, including Virtual Urgent Care, Virtual Primary Care, Behavioral Health, and Pharmacy Benefits. Virtual Urgent Care and Virtual Primary Care can be accessed through the patient portal. Behavioral Health and Pharmacy Benefits are provided through independent third-party providers, and any online access to these services is provided via those third parties’ platforms. These platforms are not owned or operated by ActuateCare and are subject to the terms of use and privacy policies of the respective providers.
These Terms of Use (the "Terms") constitute a binding agreement between you ("You" or "Your") and ActuateCare. By using or continuing to use ActuateCare services, you indicate that you have read, understand, and agree to these Terms and the ActuateCare Privacy Policy. IF YOU DO NOT UNDERSTAND THIS AGREEMENT OR DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU MAY NOT USE THE SERVICES.

By continuing to use the Services, You agree and certify as follows: ​

Any information that we collect through your use of the services is subject to the ActuateCare Privacy Policy.

You are at least 18 years of age, legally emancipated, or you are a parent, legal guardian, or other authorized adult acting on behalf of a minor patient who is at least 2 years of age.

If the patient is under 18 years of age (a “minor”), an accompanying parent, legal guardian, or other authorized adult must be present for all telehealth visits and must provide consent on behalf of the minor.

The healthcare providers you consult with are independent licensed providers.

You are physically located in the state you indicate when requesting services.

You will use the Services in compliance with applicable laws and these Terms of Use.
ActuateCare for Emergency Medical Needs
If you are experiencing a medical emergency, call 911 immediately. ActuateCare’s services are not intended to replace your relationship with an in-person medical provider and are not appropriate for all medical conditions.

Arbitration Notice
Except if you opt-out, you agree that disputes between you and ActuateCare will be resolved by binding, individual arbitration. By continuing to use the Services, and unless you opt-out, you waive your right to participate in a class action lawsuit or class-wide arbitration.

You can opt-out of the Arbitration Agreement by contacting info@actuatecare.com within 30 days of accepting these terms.

What is ActuateCare?
ActuateCare connects you to licensed healthcare providers for Virtual Urgent Care and Virtual Primary Care through the ActuateCare patient portal. ActuateCare also facilitates access to Behavioral Health and Pharmacy Benefits through independent third-party providers.

Any access to Behavioral Health or Pharmacy Benefits may require you to use the third party’s own website, portal, or application.

These platforms are not owned or controlled by ActuateCare.

Your use of those third-party services is governed by their own terms of use and privacy policies.

Who is Eligible to Use ActuateCare? ​
By requesting or accessing services, you represent and warrant:

The information you provide during intake or registration is true, accurate, current, and complete.

You will update your information as needed to maintain its accuracy.

ActuateCare Does Not Provide Medical Advice or Services

All medical and other professional healthcare services that you receive are provided by independent licensed providers, not by ActuateCare, LLC.

ActuateCare does not control the clinical judgment of these providers and is not responsible for medical malpractice or substandard care delivered to you.

For Behavioral Health and Pharmacy Benefits, the services are delivered entirely by third-party providers.

Third-Party Platforms

Some services may be accessed via third-party platforms not owned or operated by ActuateCare.

ActuateCare does not control and is not responsible for the content, security, or performance of these platforms.

Your use of any third-party platform is subject to the terms of use and privacy policy of that platform.

Changes to These Terms

ActuateCare may change or modify these Terms at any time without prior notice.

If we change or modify these Terms, we will notify you by posting a new version of the Terms and/or sending an updated version via secure email.

If you continue to use the Services after notification, you agree to be bound by the modified Terms.

Governing Law

These Terms are governed by the laws of the State of Tennessee without regard to its conflict of laws principles.

The courts of the State of Tennessee have jurisdiction over any action arising under these Terms or Your use of the Services.
